1. Agreement to Terms

By accessing or using Zaagster, a brand of Zaags, operated by RUDLU ULDA (NIF: 516730304), a company registered in Lisbon, Portugal ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Zaagster is a progressive web application (PWA) that allows users to:

  • Save and organize favorite places
  • Share places with friends
  • Discover recommendations from connections
  • Plan trips and create itineraries
  • Write and read reviews

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Requirements

  • You must be at least 16 years old to use the Service
  • You may only create one account per person
  • Accounts are non-transferable

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion.

4. User Content

4.1 Your Content

You retain ownership of content you create ("User Content"), including:

  • Places you save and their descriptions
  • Reviews and ratings
  • Profile information
  • Comments and messages

4.2 License to Us

By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the Service.

4.3 Content Responsibilities

You are solely responsible for your User Content. You agree NOT to post content that:

  • Is false, misleading, or deceptive
  • Infringes on intellectual property rights
  • Contains hate speech, harassment, or threats
  • Is sexually explicit or pornographic
  • Promotes illegal activities
  • Contains malware or harmful code
  • Violates any applicable law or regulation

4.4 Content Moderation

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated means to access the Service without permission
  • Collect user information without consent
  • Send spam or unsolicited messages
  • Circumvent any access controls or rate limits

6. Direct Messaging

The Service includes direct messaging features:

  • Friends Only: You may only send direct messages to users with whom you have a mutual friend connection
  • Message Content: All Content Responsibilities (Section 4.3) apply to direct messages
  • Encryption: Messages are encrypted at rest for security, but may be accessed by Zaagster for legal compliance or abuse investigation
  • No Harassment: Using messages to harass, threaten, or abuse other users will result in account termination
  • Report Abuse: Users can report abusive messages at abuse@zaagster.com

6b. Contact Import and Friend Discovery

The Service allows you to import contacts to find friends:

  • Consent: By importing your contacts, you confirm that you have the right to share those contact details with us for the purpose of friend discovery
  • Storage: Imported contacts (first name, last name, email, phone) are stored encrypted on our servers. See our Privacy Policy for details
  • Usage: Contacts are used solely for matching against existing Zaagster users and enabling you to send invites
  • No Spam: We will never send unsolicited communications to your contacts. Invites are only sent when you explicitly choose to invite a contact
  • Deletion: You may request deletion of your imported contacts at any time

7. Third-Party Services

The Service may integrate with third-party services, including:

  • Google Maps and Places API
  • Authentication providers (Google, Apple, Discord)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Zaagster and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Accuracy or completeness of information
  • Uninterrupted or error-free operation
  • Security of data or communications

We do not guarantee the accuracy of place information, reviews, or recommendations. Always verify important details independently.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAAGSTER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute services

Our total liability shall not exceed the amount you paid us (if any) in the past 12 months.

12. Indemnification

You agree to defend, indemnify, and hold harmless Zaagster and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending notification through the Service (for material changes)

Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
